The team of Nazar Kulchytskyy & Partners Law Firm received and provided a brief overview of the full text of the HACC resolution on the refusal to apply a preventive measure for Oleksandr Liiev.
As for Oleksandr Liiev himself, the investigating judge stated the following:
- ● the materials provided, in particular, the materials of covert investigative detective actions, have no indication of the organized group present, on the contrary – they refute any cooperation between the suspects;
- ● the prosecution did not provide materials that could indicate that Mr. Liiev or other managers of the Lviv Arsenal Company did not intend to supply mortar rounds to the Armed Forces;
- ● there are no signs of Liiev acquiring the money; the payments made met the purpose of the contract and were paid to the counterparties that are directly involved in the production and supply of the ammunition.
The main decision of the investigative judge is stated in the following paragraph:
a law enforcement agency cannot substantiate a motion based on the information “noise” created in the media about the circumstances of a particular case (the pre-determined role and actions of persons), and therefore, in a country that is defending itself against the armed aggression of the Russian Federation, the prosecution of officials of the Ministry of Defense of Ukraine cannot be based solely on the facts of a person’s signing a certain agreement and the application of the strictest preventive measure, like any other, must be justified, otherwise, the fear of possible criminal prosecution when signing other military contracts will prevail over the objective need, taking into account normal business risks, to saturate our army with means of attack, which will undoubtedly affect the overall defense capability of the state.’
Regarding the case in general, the investigating judge stated that the law enforcement agency has enough materials for the pre-trial investigation to be performed which must establish the circumstances behind the signing of defense contracts between the Ministry of Defense of Ukraine and the Lviv Arsenal Company.
